Tourist Apartments: Supreme Court annuls the national registry

The Spanish Supreme Court has recently annulled the State Single Registry for Short-Term Rentals, a measure promoted by the Government to control tourist apartments and short-term rentals advertised on digital platforms such as Airbnb or Booking.

The decision has raised many doubts among property owners, investors, and real estate professionals. In this article we clearly explain what has happened, why the Supreme Court made this decision, and what consequences it may have for the housing market and tourist rentals in Spain.

What was the Single Registry for Short-Term Rentals?

The Government had created a state system requiring short-term and holiday rentals to:

register in a national registry

obtain an official identification number

display this number on the digital platforms where they are advertised

The aim was to increase control over this type of accommodation, combat illegal listings, and improve market transparency.

It also aimed to facilitate information exchange between platforms and public administrations.

Why did the Supreme Court annul it?

The Supreme Court considers that the State does not have sufficient powers to create a mandatory nationwide single registry for tourist accommodation.

According to the ruling, the regulation of short-term rentals is mainly related to:

tourism

land use planning

housing

These powers belong to the autonomous communities.

This means each region can continue establishing its own rules, registries, and requirements for short-term rentals.

In other words, the Court does not question the existence of control, but who has the authority to impose it.

Do controls on tourist apartments disappear?

No.

The ruling does not eliminate regional regulations or administrative control over this type of housing.

Owners will still have to comply with:

regional regulations

licenses required in each region

tax obligations

In addition, digital platforms will continue cooperating with administrations and sharing information when necessary.

What disappears is the obligation of a single national registry that overlaps existing regional systems.

What does this decision mean for owners and investors?

Greater role of regional governments

Each autonomous community will continue regulating short-term rentals independently. This means rules may vary significantly depending on location.

For example:

some cities are limiting new licenses

others require specific conditions

some regions maintain more flexible controls

Therefore, it is now more important than ever to understand local regulations before renting a property for tourist purposes.

More importance of professional advice

Holiday and short-term rental regulations have become increasingly complex.

For owners and investors, specialized real estate and legal advice can help avoid:

penalties

administrative issues

unprofitable investments

Understanding each region’s specific rules is key to making safe decisions.

The housing debate remains open

This judicial decision comes at a time of strong pressure on the housing market:

rising rental prices

difficulty accessing housing

growth of tourist apartments in many cities and destinations

The debate between promoting tourism and protecting housing will remain one of the major issues in the coming years.

What may happen next?

It is likely that:

autonomous communities will strengthen their own registries and controls

the Government will seek new coordination mechanisms

further reforms related to housing and short-term rentals will continue

The real estate sector will closely follow future court decisions and potential legislative changes.

Conclusion

The annulment of the Single State Registry does not mean the end of control over tourist rentals, but rather a shift in regulatory authority.

Autonomous communities will continue to be primarily responsible for regulating tourist accommodation and short-term rentals.

For owners, investors, and real estate agencies, staying informed and acting with legal certainty is more important than ever.
